Mortgage Attorney - Remote- Must be able to practice law in CA

Job Description
The successful candidate will have responsibility for providing legal advice to company on a full range of legal, regulatory, licensing, litigation and compliance matters that may arise in connection with its mortgage and related operations.  The candidate will also be required to assist legal and business operations staff in enhancing systems, internal controls and policies and procedures to assure compliance with all applicable laws and regulations.
 
 
Candidate Qualifications
  • 7+ years mortgage banking legal experience.
     
  • Excellent verbal and written communication skills.
     
  • JD from an accredited school - strong academic record required.
     
  • Familiar with the Nationwide Mortgage Licensing System ("NMLS") and the SAFE Act.
     
  • Thorough knowledge of federal and state laws associated with the mortgage industry.
     
  • Must have high interpersonal skills to handle a variety of situations; position continually requires demonstrated poise, tact and diplomacy.
     
  • Must be detail oriented.
 
Skills/Requirements
  • Counsel mortgage division management on a wide range of legal matters.
     
  • Maintain a strong and effective partnership with clients, provide legal advice proactively, and give clients legal advice that is insightful, pragmatic and timely.
     
  • Work well with associates at all levels of the organization and in the Bank's affiliates, including direct interaction with senior management.
     
  • Review, negotiate and draft consumer contracts, disclosures, marketing material and related documents.
     
  • Effectively managing multiple competing priorities.
     
  • Work independently and handle a high degree of responsibility.
     
  • Identification of significant legal exposures and development of appropriate risk reduction protocols.
     
  • Manage and oversee mortgage insurance enterprise-wide litigation and legal liability risk assessment including management of disputes, collaborating with business unit leaders and other staff attorneys, making recommendations regarding litigation strategy, settlement or case disposition and representing the company as necessary at mediations, settlement discussions and hearings.  Also participate in selection and management of outside counsel.
     
  • Providing legal services to Company's Human Resources department to include, but not limited to advising on employment-related complaints and response, reviewing revisions to HR policies and procedures, and rendering advice on operational issues such as investigations and foreign citizen employment.
